In August, SHCA addressed a letter of
concern to Don Morgan, the Minister of
Labour Relations and Workplace Safety,
and requested a review and amendment of
the current system, the process and policies
as it relates to employees’ compensation.
As of mid-September, SHCA had not re-ceived
a response from Morgan, nor has the
WCB addressed the issue and opened a dia-logue
with SHCA.
“It seems like we have really hit a wall
here,” Lipp explained.
Under the current system, the WCB
doesn’t allocate the proper amount of time
to investigate employee claims. Instead,
there is a presumption that an employee’s
injury occurred because of his or her em-ployment
and not willful misconduct. The
full burden of proof rests on an employer to
prove otherwise.
The WCB has a one-day allowance for
time off work for medical reasons before
awarding loss of income to an employee
and a lost-time injury to an employer. This
leaves no opportunity to assess the severity
of the injury, or to establish whether it was
in fact a result of a work-related incident.
Further complicating the matter, Sas-katchewan
does not have an Employer’s ad-vocate,
which exists in other jurisdictions.
